We assist companies in identifying and avoiding competition law risks. The firm represents clients concerned by alleged or actual antitrust violations in investigations and competition fine proceedings before the European Commission, the Union Courts and the national competition authorities. The firm has considerable and proven experience in leniency and settlement proceedings.
Cartel damage claims
We support clients involved in cartel damage disputes. The firm has significant experience in coordinating litigation worldwide.
Subsidies and state aid
We advise clients comprehensively on EU state aid law and international anti-subsidies rules and regulations, including the WTO Agreement on Subsidies and Countervailing Measures. The firm represents clients in state aid proceedings before the European Commission and the Union courts. The firm has particular experience in reviewing Swiss regulations and measures for their compatibility with EU state aid law, the Swiss-EU air transport agreement and the free trade agreement and with other international obligations of Switzerland.
Merger and Foreign Direct Investment Control
We provide competition law support in connection with M&A transactions. The firm carries out feasibility studies, assists in drafting contractual terms, examines filing obligations under the relevant merger control and investment control regulations, and undertakes filings in the relevant jurisdictions.
Contracts
We assist in the drafting of supply and purchase agreements, distribution agreements, license agreements, research and development agreements, joint ventures and other cooperation agreements with competitors, suppliers, buyers, distribution partners and other market participants.
